2. Scope of Application

These General Terms and Conditions of Sale (hereinafter "GTC") govern distance sales contracts concluded through the website lazyghost.it between Lazylab s.r.l.s. (hereinafter "Lazyghost") and final consumers (hereinafter "Customer"), in accordance with Legislative Decree 206/2005 (Consumer Code) and Legislative Decree 70/2003 (Electronic Commerce).

"Consumer" means any natural person acting for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out.

These GTC apply exclusively to purchases made through lazyghost.it. For supplies intended for retailers, gyms, teams or professional entities, please contact vendite@lazyghost.it.

3. Purchase Procedure

Purchases on lazyghost.it are made through the following steps:

1. The Customer selects the desired products and adds them to the cart.
2. The Customer proceeds to checkout, entering shipping details and choosing the payment method.
3. The Customer reviews the order summary and confirms the purchase via the payment button.
4. Upon completion of payment, Lazyghost sends the Customer an order confirmation email to the address provided. This communication constitutes acceptance of the order by Lazyghost and the conclusion of the contract.

Lazyghost reserves the right to refuse or cancel orders in the event of technical errors, product availability issues, or a reasonable suspicion of fraud. In such an event, the Customer will be promptly notified and refunded the full amount paid.

Products remain the property of Lazyghost until full payment of the price by the Customer.

4. Prices and Payment Methods

Prices

All prices indicated on lazyghost.it are expressed in Euros (€) and are inclusive of VAT, unless otherwise specified. Shipping costs, where applicable, are indicated separately during the checkout process and are included in the final order total.

Lazyghost reserves the right to modify prices at any time; changes will not affect orders already confirmed.

Accepted payment methods

Lazyghost accepts the following payment methods:

All payments are processed securely using SSL encryption protocols. Lazyghost does not store Customer credit/debit card data.

In case of a refund, it will always be made using the same payment method used for the original purchase, within the technical times provided by the banking circuit or payment processor.

Gift vouchers

Gift vouchers purchased on lazyghost.it are not refundable in cash and cannot be converted into monetary credit. There is no provision for returning the residual value in cash.

5. Right of Withdrawal

Terms and conditions

The consumer Customer has the right to withdraw from the purchase contract, without needing to provide any reason, within 14 (fourteen) days from the date on which the Customer or a third party designated by them (other than the courier) acquired physical possession of the goods, pursuant to Articles 52 et seq. of Legislative Decree 206/2005.

The right of withdrawal can be exercised by sending an explicit communication to: hello@lazyghost.it, indicating the order details and the intention to exercise the right of withdrawal. The standard withdrawal form provided in Annex I, Part B, of Legislative Decree 206/2005 can be used, but it is not mandatory.

Exclusions from the right of withdrawal

Pursuant to Article 59, paragraph 1, letter e) of Legislative Decree 206/2005, the right of withdrawal is excluded for:

• Sealed goods which are not suitable for return for health protection or hygiene reasons and were unsealed after delivery. This category includes all chalk products (powder, liquid, refillable ball) whose original seal or packaging is found to be open or compromised upon return.
• Goods which are, by their nature, inseparably mixed with other items after delivery (e.g., chalk powder already poured or liquid chalk partially used).
• Gift vouchers, which by their nature are not subject to withdrawal or refund.

For all other products (clothing, accessories, merchandise), the right of withdrawal can be exercised within the ordinary 14-day period, provided that the products are intact, unused, in their original received condition, and complete with labels and original packaging.

Return shipping costs

In the event of a legitimate withdrawal, the costs of returning the goods are borne by the Customer, unless otherwise agreed in writing. The goods must be returned to the address of the registered office:

Lazyghost will refund the Customer the full amount paid for the product, net of original shipping costs, within 14 (fourteen) days of receipt of the returned goods, using the same payment method used for the purchase.

Partial returns and discount codes

In case of a partial return of an order, any discount codes or loyalty points applied to the original order will not be returned or re-credited.

6. Legal Guarantee of Conformity

All products sold on lazyghost.it are covered by the legal guarantee of conformity provided by Legislative Decree 206/2005, as amended by Legislative Decree 170/2021, for a period of 24 (twenty-four) months from the date of delivery.

In case of a lack of conformity, the Customer has the right, first, to have the conformity restored through repair or replacement of the goods. If these remedies are not practicable, the Customer may request a price reduction or termination of the contract.

The warranty is managed directly by Lazylab s.r.l.s. for products purchased on lazyghost.it. For products purchased from resellers or affiliated gyms, the warranty is managed by the relevant reseller or supplier.

To report a defect, the Customer must send a communication to hello@lazyghost.it with a description of the problem and, if possible, photographs of the product and packaging.

7. Damaged or Incorrect Goods

In the event that the Customer receives a product damaged during transport or a product different from the one ordered, they are invited to immediately contact Lazyghost at hello@lazyghost.it, attaching photographs of the product and the outer packaging.

Lazyghost will assess the situation on a case-by-case basis and identify the most appropriate solution (product replacement, partial or total refund), without additional charges for the Customer.

8. Exclusions and Limitations of Liability

Lazyghost is not responsible for:

• Delays or non-deliveries due to force majeure, exceptional events, or courier service malfunctions.
• Errors in entering shipping data by the Customer.
• Indirect damages, loss of profit, or consequential damages arising from the use or inability to use the purchased products, within the limits permitted by applicable law.
• Website malfunctions due to technical causes beyond Lazyghost's control.

Nothing in these GTC excludes or limits Lazyghost's liability in cases provided by law as mandatory (e.g., fraud, gross negligence, personal injury).

9. Intellectual Property

All content present on lazyghost.it — including, but not limited to, texts, images, logos, graphics, photographs, videos, and the "Lazyghost" brand — are the exclusive property of Lazylab s.r.l.s. or third parties who have authorized their use, and are protected by current legislation on copyright and industrial property.

Any reproduction, distribution, modification, or commercial use of the site's content without prior written authorization from Lazylab s.r.l.s. is prohibited.

10. Personal Data Protection

11. Dispute Resolution

Attempt at amicable settlement

In case of a dispute relating to the purchase, the Customer is invited to first contact Lazyghost at hello@lazyghost.it. Lazyghost undertakes to respond within a reasonable time and to seek an agreed solution before resorting to any formal procedure.

Alternative Dispute Resolution (ADR/ODR)

Pursuant to EU Regulation no. 524/2013, Customers residing in the European Union have the right to use the European Commission's ODR (Online Dispute Resolution) platform for the out-of-court resolution of disputes relating to online purchases:

Lazyghost declares its willingness to participate in mediation or out-of-court conciliation procedures before proceeding legally.

12. Applicable Law and Competent Court

These GTC are governed by Italian law. For any dispute that cannot be resolved amicably, the Court of the consumer's place of residence or domicile will be competent, if residing in Italy, pursuant to Article 66-bis of Legislative Decree 206/2005.

For consumers residing in other European Union countries, the provisions of local consumer protection law apply where these offer superior protections compared to Italian law.
